Eligibility
The Forbes Digital Plaza Music Video Showcase ("the Showcase") is open to all participants of age 18 and older. For a group of individuals to enter the Showcase (a “Team”), at least one representative of the Team must currently live in Pittsburgh and submit the entry on behalf of the Team. Each individual of the Team must agree to these Rules.
Entry Period
You may enter the Contest from April 1, 2018 until April 15, 2018 (“Contest Period”).
Specific Entry Requirements
You must enter your Submission online during the Contest Period. Time and eligibility of entry will be determined by the jury in its sole discretion.
No Team may enter more than one Submission.
Your Video must be five (5) minutes or less in length (including opening and closing credits).
Your Video must not infringe any third party copyright or trademark, or violate the rights of any person or entity. Make sure that you only use content in your Video that you are authorized to use, including, without limitation, music, images, film clips and other intellectual property. If you use preexisting content that you are not authorized to use, you are not eligible to enter this Contest and your Submission will be disqualified. Note that this provision is not intended to preclude you from incorporating public domain content into your Video.
Your Video may not contain images or likenesses of any individuals who have not provided their authorization to have their images or likenesses used for the purposes contemplated herein. Images of individuals aged below 18 years are not allowed without specific parental consent.
Your Video may not contain material that is obscene, defamatory, libelous, threatening, pornographic, offensive, or encourages conduct that would be considered a criminal offense, gives rise to civil liability, or violates any law (including, without limitation, the privacy or publicity rights of any individual whose likeness appears in the Video). Videos must be appropriate for viewing by the general public and by a multi-cultural international community; appropriateness will be determined by the jury in its sole discretion.
Intellectual Property Ownership and Permissions
You retain copyright ownership in your Video. However, the Showcase has permission to use images and videos derived from your Submission in promotion of the Showcase.
The jury reserves the right to verify the ownership and originality of any Video. You hereby agree to submit proof of ownership or any release, license, or permission received from a third party granting you (or your Team) the right to use content, images, and likenesses in your Video. Failure to provide such proof upon request will result in disqualification from the Showcase.
You agree to indemnify and hold the jury members, organizers and their respective affiliates, officers, directors, agents, attorneys and employees (collectively, “Indemnitees”) harmless from any and all claims, damages, expenses, costs (including attorney fees), and liabilities (including settlements), brought or asserted by any third party against any Indemnitees due to or arising out of your Submission or your conduct during this Showcase, including without limitation, trademark, copyright, or other intellectual property right, right of publicity, right of privacy, or defamation.
For the avoidance of doubt, participation in this Showcase does not impact your ability to upload your Video to other online platforms.
General Terms and Conditions
By participating, you agree that the jury and organizers are not responsible or liable and are released and held harmless from 1) any incorrect or inaccurate information, whether caused by website users or by any equipment or programming associated with or utilized in the Showcase, or by any technical or human error that may occur in the processing of submissions to the Showcase, including but not limited to any misprints or typographical errors; 2) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; 3) any problems or technical malfunction of any telephone network or lines, computer equipment, servers, providers, computer online systems, software, or failure of email on account of technical problems or traffic congestion on the Internet or at any website, including injury or damage to participant's or to any other person's computer related to or resulting from participating or uploading images or information in the Showcase; 4) any and all losses, damages, expenses, rights, claims and actions of any kind in connection with or resulting from participation in the Showcase, association or involvement with a Video or Submission, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, intellectual property, defamation, or invasion of privacy.
You agree that any and all disputes that cannot be resolved with the jury, and causes of action arising out of or connected with this Showcase, shall be resolved individually, without resort to any form of class action. IN ANY SUCH DISPUTE, PARTICIPANT SHALL NOT BE ENTITLED TO ANY PUNITIVE, SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION ATTORNEYS' FEES, OR ANY DAMAGES OTHER THAN PARTICIPANT'S ACTUAL OUT-OF-POCKET EXPENSES (IF ANY) ASSOCIATED WITH PARTICIPATING IN THE CONTEST. YOU HEREBY WAIVE ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED. The Showcase is provided "as is" without warranty of any kind, either express or implied.
